Buyers: please understand that you are expected to sign either a Buyer Agency or Transaction Brokerage Agreement that ensures Your Agent will get paid for the services You receive, IN ADVANCE of showing you any property, so you know IN ADVANCE what agency professional fees could be YOUR responsibility. As of March 2026, Listing brokerages are no longer allowed to negotiate for Buyer Agency compensation at the time of listing. A listing brokerage can only determine what their own listing commission/fee will be, and if it also brings the buyer to the table. Buyers or buyers' broker now have the option to request and negotiate Buyer Brokerage compensation from Sellers in conjunction with a submitted offer, so therefore Buyers should know up front that they may be responsible for some, none or all of their agent's compensation, pending the Seller and the offer.
